General Sales Conditions

Camping Travel Club provides vacation stays during the low season through programs such as Camping Cheque, Holiday Cheque, Silver Card and Gold Card proposed by the Kawan Group, a simplified joint-stock company with capital of €1,276,500, listed with the Chalon sur Saone Register of Commerce under number 418 679 643, whose registered office is located at Espace Entreprises, 12, Rue Alfred Kastler, 71530 Fragnes, France and whose administrative office is located at Espace Don Quixote, 547, quai des Moulins, 34201 Sète, France. Kawan Group’s intracommunity VAT number is: FR61418679643.

Clients can contact the Kawan Group at the following phone number: +33(0)3.85.72.29.90 Monday to Friday from 9am to 6pm and Saturday from 9am to 12 noon and from 1pm to 5pm.

Kawan Group is certified with the Register of Travel Operators and Séjours ATOUT France under no. IM071100003. The Kawan Group is thus financially guaranteed by the bank “Caisse d’Epargne et de Prévoyance Bourgogne Franche-Comté”, located at 1, Rond-point de la Nation, 21000 in Dijon, France and has taken out a professional liability insurance policy with Allianz Iard, 87, Rue Richelieu, 75002 Paris, France.

“Camping Travel Club”, “Camping Cheque” and “Holiday Cheque” are trademarks owned by the Kawan Group registered with the National Institute of Industrial Property (INPI).

These general sales conditions are reserved for retail consumers within the meaning of the law and jurisprudence, acting exclusively for their own account. They apply to all sales of the Kawan Group’s Camping Travel Club made through the Central Booking and Information Office and/or the website www.campingtravelclub.com or via a distribution partner.

The Client confirms being aware of these sale conditions before confirming the Order. Order validation implies full acceptance without limitation or qualification of these terms and conditions.

These terms and conditions are valid as of 1 December 2015.

Kawan reserves the right to modify at any time these terms and conditions by posting a new version online at
www.campingtravelclub.com. The General Sale Conditions are those in effect on the date the Order is validated.

DEFINITIONS

The meaning of the following terms and expressions, when preceded by a capital letter, for the purposes of the interpretation and execution of the present are:

“Article”: the item ordered;

“Item”: vouchers, paper or digital, used to stay in the Camping Travel Club network sold on the website or by the Central Booking and Information Office;

“Silver Card” and “Gold Card”: rechargeable smart cards used to prepay nights at campsites, aparthotels, hotels or Moroccan Riads of the Camping Travel Club Network in the low season;

“Central Booking and Information Office”: Seller’s information call centre where Articles, Items or nights can be reserved within the Camping Travel Club Network. Clients can contact the Central Book-ing and Information Office at the following phone number: +33(0)3.85.72.29.90 Monday to Friday from 9am to 6pm and Saturday from 9am to 12 noon and from 1pm to 5pm.

“Order”: Client purchase request for an Item from the Seller.

“General Sales Conditions”: the general terms and conditions of sale, the subject of the present;

“Contract”: the present document, including its preamble, annexes and any amendments, substitutions, extensions or renewals herein pursuant to agreement of the Parties;

“Delivery Period”: time between the date the Order is validated and the date of Delivery to the Client;

“Delivery Cost”: expenses incurred by the Seller in delivering the Order to the Delivery address indicated by the Client.

“Europe Guide”: guide published annually by the Seller indicating the members of the Camping Travel Club network;

“Delivery”: shipment of the Article to the Client;

“Delivery Method”: means any standard or express delivery mode available on the Website at the time of the Order;

“Price”: the unit value of the Item; this includes all taxes but not Delivery Cost;

“Total Price”: the total amount of all Items purchased in the Order; this amount includes all taxes;

“All-inclusive Price”: the Total Price to which is added the Delivery Cost; this amount includes all taxes;

“Camping Travel Club Network”: establishment offering low season nights through the Seller;

“Service”: any service offered for sale in the Catalogue or on the Website;

“Website”: online sales Website www.campingtravelclub.com used by the Seller for the marketing of its Items;

“Seller”: the Kawan Group;

“Online sales”: marketing of the Seller’s Items through the Website;

References to the Camping Travel Club are references to the Camping Travel Club of this Contract, unless otherwise provided.

References to the singular include the plural and vice versa.

Any reference to one gender includes the other.

CAMPING TRAVEL CLUB SERVICES

Camping Travel Club offers its Clients vouchers on paper or personal digital units having a unit value of €16 that can be exchanged for a bare pitch, a bungalow, an equipped tent, a mobile home, or accom-modation in an aparthotel, hotel or Moroccan Riad during the low season in establishments affiliated with the Camping Travel Club Network.

BARE PITCH RENTALS

The paper or digital unit voucher worth €16 used to rent a bare pitch entitles a stay during low season for one night for 2 persons according to the acceptance dates in one of the affiliated campsites of the Camping Travel Club Network in Europe and Morocco. A bare pitch includes a standard location for 1 caravan + 1 car, or 1 mobilehome, or 1 tent with electricity 6A (or 5 kW/day maximum), access to hot showers, plus a dog at campsites that accept them. The Price of a stay does not include the tourist tax or the eco-tax, any additional people, electricity consumption over 5 kW/day, as well as all other services charged according to the campsite’s tariffs.

Bare pitch rentals at campsites in the Camping Travel Club Network require no prior reservation. The duration of stay at the campsite is not limited.

EQUIPPED TENTS, MOBILE HOMES, BUNGALOWS AND ACCOMMODATION IN AN APARTHOTEL, HOTEL OR MOROCCAN RIAD

Unit voucher worth €16 used for renting an equipped tent, a mobilehome, bungalow or accommodation in an aparthotel, a hotel or Moroccan Riad, entitles you to a one night low season stay for 4 people, according to the acceptance dates in one of 300 establishments of the Camping Travel Club Network. Details of services provided can be found on the Seller’s website or in the Europe Guide. Prices per night and per type of accommodation are listed on the Seller’s Website and in the Europe Guide and correspond to the number of €16 units with a minimum Price of €32 per night. The minimum length of stay in these accommodations is two nights.

RESERVATIONS OF MOBILHOMES, BUNGALOWS, EQUIPPED TENTS AND ACCOMMODATIONS IN APARTHOTELS, HOTELS OR RIADS

In order to ensure the availability of accommodations for desired dates, Clients must make a prior reservation.

From January to March: Monday to Friday from 9am to 6pm

From October to December: Monday to Friday from 9am to 12 noon and from 2pm to 6pm.

Proposed stays are available, in principle, subject to the Seller’s verification with the establishment concerned; any changes will be exceptional and beyond the control of the Seller. The Seller reserves a delay of 24 hours to confirm the reservation by email or phone.

The Price of stays

Prices of stays are quoted in euros and are available from the Central Booking and Information Office at: 03 85 72 29 90 from France and 00 333 85 72 29 90 from outside France or on the website: www.campingtravelclub.com. Prices and tariffs are confirmed by the Seller at the time of booking. The flat rate fee is for the rental period and the number of people indicated as well as a normal amount of water, gas, and electricity consumption, vehicle parking and access to the reception and leisure facili-ties, unless otherwise specified.

The booking Price proposed is not combinable with commercial offers or promotions. Commercial offers and promotions cannot be retroactively applied and are valid only during the specified period.

The Price does not include:

– Cancellation insurance (non-mandatory), optional insurance offers and services, cleaning costs (some facilities may include them in the reservation), bed sheets, additional services (extra people, pets, rental of a safe, and a baby kit…), paying activities offered by the campsite and tourist or communal taxes that are usually paid on-site unless otherwise specified when booking. Prices do not include transportation or personal consumption costs.

Occupancy is strictly limited to the number of persons indicated when the reservation is made and within the maximum number of persons limited for the accommodation within the Camping Travel Club formula. A baby or child counts as one person.

Any change made by the Client in the number of people is subject to a specific request from the Cen-tral Booking and Information Office six days before arrival. As appropriate, for any changes the provisions in section “Modification” will apply.

Payment Terms

Reservations imply full acceptance of the General Sales Conditions and special terms.

Payment of rented mobile homes, bungalows or equipped tents and accommodations in aparthotels, hotels or Riads can only be made with a digital unit charged on a “Silver Card” or a «Gold Card».

Payment is debited by the Seller no later than 5 days prior to arrival.

If the number of units on his “Silver Card” or “Gold Card” is insufficient to pay the full stay, the Client will be informed in advance and must reload the number of units needed onto the card to make the payment no later than 6 days before his arrival. Otherwise, the reservation will be cancelled.

Modification

Any reservation change shall be confirmed by the Client in writing no later than six days before arrival by email and will be treated by the Seller by email. A change is defined as a modification that does not affect the essence of the booking in terms of destination, dates, and accommodation. The Client will be immediately informed of any refusal stating the reasons for denial. The Client can either retain his initial reservation or cancel his stay. In this case the Client will not owe any fees.

Modifications are not allowed within 5 days of arrival and if so the Client shall not be entitled to any refund of their stay.

Cancellation

In case of cancellation, the Client must immediately inform the Central Booking and Information Office by email: Contact@campingtravelclub.com or by phone: 03 85 72 29 90 from France or 00 333 85 72 29 90 from outside France

From January to March: Monday to Friday from 9am to 6pm

From April to September: Monday to Friday from 9am to 6pm and Saturday from 9am to 12 noon and from 1pm to 5pm.

From October to December: Monday to Friday from 9am to 12 noon and from 2pm to 6pm.

Any cancellation made by the Client will lead to the following charges:

Cancellation insurance is never reimbursed.

Any interrupted or shortened stay, or any unused service by the Client for any reason whatsoever, does not give rise to a refund.

Reception and conditions of stay

Once the stay is paid, the Client receives (by email or letter) a confirmation summarising the booking and which serves as a confirmation to be presented to the campsite upon arrival. Generally, arrivals are from 4pm and departures before 10am. Outside these hours, it is recommended that the Client inform the campsite of their estimated time of arrival; any additional cost due to a late arrival is the sole responsibility of the Client. Beyond 24 hours without word from the Client, the Seller may dispose of the reserved accommodation without owing the Client any refund.

The Client must respect the rules of the campsite. Failure to do so resulting in expulsion from the campsite does not give right to any compensation or reimbursement. The Client’s personal belongings are strictly his own responsibility. The Client is required to insure against the risks inherent in case of theft, loss, or damage that may occur during his stay. In case of force majeure or acts of God, neither the Seller nor the campsite may be held responsible for the disturbance to the Client’s stay (drought, floods, power cuts, water, gas, strikes, or construction…) By construction, we refer to roads, buildings, etc. that may occur in the vicinity of the campsite. The Seller will always try to notify the Client of these potential nuisances if previously informed.

GUARANTEED BEST PRICE

In the event the Client books a stay at a Camping Travel Club Network campsite and if within 7 days of the reservation and at least 30 days before the beginning of his stay he finds a lower fare for the same stay on another Website, the Seller commits to credit the difference of the amount of the stay to his Silver Card or Gold Card. This offer only applies to stays purchased on one of the Seller’s websites or from the Central Booking and Information Office of the Seller and a confirmation number was sent validating the reservation.

The offer only applies to identical stays, namely:

– The site and accommodation are identical

– Identical starting date, end date and length of stay

– Identical terms of sale, including conditions for security deposit, payment, cancellation and modification of the stay…

The lower rate stay must be available on the other site at the date of the request. The Price of the stay booked with the Seller does not include the booking fee, promotional deals, “tourist packages” or “private” sales.

Handling requests:

The request must be sent to the following email address: contact@campingtravelclub.com at the latest within 7 calendar days of the booking with the Seller and at least 30 days before the date of arrival. The email should include the following information:

– A copy of the booking confirmation sent by the Seller;

– A screenshot of the competing website page showing the offer at a lower rate than that paid. The screenshot should be the final step of the third-party site’s order form (last step before payment), containing all the elements of the Order.

After verification by the office of the Seller and if all conditions of the Offer are fulfilled, the difference in the Price of the stay will be credited to one’s Silver Card and Gold Card.

CAMPING TRAVEL CLUB’S AFFILIATED ESTABLISHMENTS

The list of establishments affiliated with Camping Travel Club Network appears in the Europe Guide and is also available on the Website: www.campingtravelclub.com. This year’s Europe Guide formalises the list of establishments accepting unit vouchers in paper form or digital units. Camping Travel Club’s Network is kept up to date on the Website: www.campingtravelclub.com and on the mobile app “Camping Cheque” as well as updated information on establishments, including their opening dates and acceptance of the Seller’s unit vouchers.

Establishments that integrate the Camping Travel Club Network during the season, after publication of the Europe Guide, can be found online at: www.campingtravelclub.com and on the mobile app “Camping Cheque” updated regularly.

The Europe Guide provides a descriptive listing per affiliated establishment of the Camping Travel Club Network. This descriptive listing provides the following information: opening dates of the establishment, acceptance dates for units, specific opening dates for services, facilities, etc.

The information and images of the establishments in the Europe Guide are sent in to the Seller by the affiliates under their own responsibility. They are thus provided for information only and may not be considered contractual insofar as they may be modified during the season (e.g. closure of site by municipal decision). The establishment guarantees the authenticity and character of the information as not being misleading or deceptive. It goes without saying that Clients will be informed of any amendment as soon as the Seller is informed.

Details of services and descriptions of the accommodations are available on the Website www.campingtravelclub.com or may be provided to the Client by calling the Central Booking and Information Office at 03 85 72 29 90 from France or 00 333 85 72 29 90 from outside France.

The information contained in the 2016 Europe Guide was updated in September 2015 for the 2016 season.

In case of any complaints during a stay in an affiliated establishment to the Camping Travel Club Network, the Client must immediately contact Camping Travel Club’s European central office at:

The management and claims centre reserves the right to a 2-month delay from the receipt of the claim.

THE UNIT VOUCHER ON PAPER

The unit voucher is a paper document used to prepay overnight bare pitch stays at campsites of the Camping Travel Club Network. The unit voucher on paper consists of two parts. A first part to be completed by the Client containing the following information: Gold/Silver Card ID; Name, Address, Postcode, City, Country and a detachable tab kept by the campsite as a receipt.

Paper unit vouchers are to be submitted to the Camping Travel Club Network’s affiliated campsite upon the Client’s arrival.

The unit price of a paper voucher is €16. Administrative costs for processing unit vouchers is €8 per Order. A unit voucher is valid for 2 calendar years.

DIGITAL UNITS ON A “SILVER CARD” or a «GOLD CARD»

Digital units can be credited either on a “Silver Card” or a «Gold Card».

The “Silver Card” and “Gold Card” are rechargeable plastic smart cards used to prepay bare pitch overnight stays and the rental of mobile homes and bungalows at campsites of the Camping Travel Club Network. The units are credited to the Client’s card and debited when booking or when staying.

The Price of a “Silver Card” is €6. Administrative costs for processing digital units is €6 per Order. The card is valid for the Client’s lifetime and the units are valid for two calendar years.

The “Gold Card” is purchased as a 3 year subscription. The “Gold Card” subscription Price is €24, thus €8 per year. Administrative costs for processing unit credits is €4 per Order and the units have a term of four calendar years, non-renewable. The card is valid for an initial period of 3 years and thereafter renewable by tacit agreement for a further 3-year period. If the Client does not wish to renew his card, he must inform the Seller by email or registered letter at least one month before the card’s expiration.

Before each use and under his responsibility, the cardholder must ensure the card’s account has a sufficient available balance to pay for his stay in a timely manner.

Camping Travel Club vouchers on paper or digital units are not assignable or transferable to other users. Camping Travel Club Network affiliated campsites are obliged to refuse paper or digital vouchers presented by any person other than the cardholder.

SPECIFIC ADVANTAGES OFFERED TO “GOLD CARD” HOLDERS

The “Gold Card” entitles the holder, during the subscription period, to a number of privileges, services and benefits. The “Gold Card” holder receives the annual guide and the 3 Seasons Magazine. He also has reduced rates on the cost of loading new units as well as a dedicated phone line and special offers at Camping Travel Club’s Network of affiliated campsites.

The privileges and additional benefits that the “Gold Card” provides are limited to the duration of the subscription. However, the valid units credited to the “Gold Card” can be used after the card’s subscription ends within the limits of the unit’s validity.

LOYALTY PROGRAM

The loyalty program rewards your use of the Gold Card. Each year, between 1 January and 31 December, for each unit purchased with your “Gold Card” at the Camping Travel Club affiliates, the cardholder will be granted loyalty points.

These loyalty points can be redeemed for either free units credited to your Gold Card or against goodies (advertising items) or gifts selected from a list drawn up by the Vendor. Every 1 January, the “Loyalty Program” accounts are cleared to zero.

HOLIDAY REWARDS PROGRAM

The “Holiday Rewards” program is a loyalty program that compensates the holder’s use of his “Silver Card” or «Gold Card». Each year, between 1 January and 31 December, for each twenty-five (25) units used with the “Silver Card” or “Gold Card” at the Camping Travel Club affiliates, the cardholder will be offered one (1) unit worth €16. This offered unit can be used within the Camping Travel Club Network, with the same benefits and services as paid units. It will have the same duration de validity as a unit purchased on the same date. It is exchangeable under the same conditions, but not refundable. The offered unit cannot be used towards a “Holiday Rewards” credit. Every 1 January, the “Holiday Rewards” accounts are cleared to zero.

The Seller may modify all or part of the general conditions of the “Holiday Rewards” program including, but not limited to, the rules for crediting and using units, the establishments where the free units can be used at any time, with or without notice, even if such changes may affect the client’s ability to use the “Holiday Rewards” credits or unused free units earned.

Changes can be reported to the Client electronically via email, through the Camping Travel Club Network Website or by other means.

No date has been set to end the “Holiday Rewards” program, and it may continue until the Seller decides otherwise. The Seller may terminate the «Holiday Rewards» program at any time.

The Client’s continued participation in the “Holiday Rewards” program is construed as acceptance of any changes to the “Holiday Rewards” terms of use. The Client is responsible for keeping abreast of any changes the Seller makes to the “Holiday Rewards” terms of use.

The Seller reserves the right to suspend the privileges of anyone involved in fraudulent activity or who uses the “Holiday Rewards” program inconsistently to these terms of use. The Seller’s decisions are final for all questions or disputes regarding the eligibility for the program, obtaining or using the credits or compliance with these terms of use of the “Holiday Rewards”.

DURATION OF THE PAPER VOUCHERS OR DIGITAL UNITS

Paper vouchers or digital units purchased for the “Silver Card” are valid for two (2) calendar years. Those purchased in 2015 must be used between 1 January 2015 and 31 December 2016.

Digital units purchased for the “Gold Card” are valid for four (4) calendar years. Those purchased in 2015 must be used between 1 January 2015 and 31 December 2018.

END OF VALIDITY AND EXTENSION OF PAPER UNITS OR «SILVER CARD» DIGITAL UNITS

It is possible to extend the validity of the paper vouchers and “Silver Card” digital units for one calendar year. This extension can only occur once during the units’ period of validity.

From 1 January 2016 until 30 April 2016 (inclusive), paper vouchers or “Silver Card” digital units issued in 2014 whose validity expires on 31 December 2015 may be extended until December 31, 2016. Beyond 30 April 2016, extensions are no longer possible.

Processing fees for extending the validity of units are €15 per application.

The validity of digital units loaded on the “Gold Card” cannot be extended.

For any extension request for paper vouchers, the holder shall:

– Send the vouchers to be extended along with €15 to the following address: Central Office, Camping Travel Club, Kawan Group, Zone des Alleux – CS 81010 22101 DINAN Cedex France

Upon receipt of this letter within the proper delay, the paper vouchers will be extended for one calendar year and sent back to the applicant’s mailing address.

For any extension request for digital units on the Silver Card, the holder shall:

– Make a request by telephone: At 03 85 72 29 90 from France or 00 333 85 72 29 90 from outside France.

From January to March: Monday to Friday from 9am to 6pm

From April to September: Monday to Friday from 9am to 6pm and Saturday from 9am to 12 noon and from 1pm to 5pm.

From October to December: Monday to Friday from 9am to 12 noon and from 2pm to 6pm.

– Pay the €15 processing fee.

Upon receipt of this request within the proper delay, the Silver Card units will be extended for one calendar year and sent to the applicant’s mailing address.

If the paper or digital units are not used during their period of validity, the Client may not claim a refund or compensation of any kind.

TRANSFER PROCEDURE FOR «SILVER CARD» AND «GOLD CARD» DIGITAL UNITS

The transfer procedure described below applies only to digital units. Paper vouchers are nominative and not refundable or transferable.

If the holder cannot personally use his digital units, it is exceptionally possible to pass them to a third party free of charge upon request by internet at contact@campingtravelclub.com or phone at 03 85 72 29 90 from France or 00 333 85 72 29 90 from outside France.

Only valid units may be transferred. The transferred units retain their original period of validity.

REIMBURSEMENT PROCEDURE FOR «SILVER CARD» AND «GOLD CARD» DIGITAL UNITS

The reimbursement procedure described below applies only to digital units purchased by the Client. Paper vouchers are nominative and not refundable or transferable.

Only valid units purchased by the Client (excluding promotional offer purchases) may be refunded, less a 25% processing fee of the total amount of the originally purchased units.

The only grounds for reimbursement accepted by the Seller are:

  1. The passing away of the “Silver Card” or “Gold Card” holder.

The refund request must be accompanied by the holder’s death certificate.

  1. The medically certified invalidity of the “Silver Card” or “Gold Card” holder preventing him from staying in one of the Camping Travel Club Network of campsites. The refund request must be accompanied by a disability medical certificate justifying the inability of staying in one of the Camping Travel Club Network of campsites.

All supporting documents justifying the reimbursement request, such as the death certificate or medical disability certificate, must be conveyed within six months from the date of death or from the invalidity declaration. Without which, no refund can be made.

IN CASE OF LOSS OR THEFT OF THE PAPER OR DIGITAL UNITS

Paper vouchers are not exchangeable or refundable if lost or stolen.

In case of loss or theft of the “Silver Card” or “Gold Card”, the holder must immediately contact the Central Office at +333 59 59 03 59 from anywhere in Europe (price of a normal call from abroad) and 03 85 72 29 90 from France (from January to March: Monday to Friday from 9am to 6pm / from April to September: Monday to Friday from 9am to 6pm and Saturday from 9am to 12 noon and from 1pm to 5pm / from October to December: Monday to Friday from 9am to 12 noon and 2pm to 6pm) to place an opposition on the card. Once opposition has been made at the Central Office, the card will be replaced as well as the number of units on it at the time of its opposition.

The holder must pay €10 in replacement costs and for sending the new card.

Exceptionally, “Gold Card” holders, in the case of their first loss or theft, receive a free replacement card.

This replacement is valid only once during the “Gold Card” subscription period.

ORDERING PAPER UNITS OR «SILVER CARD» OR «GOLD CARD» DIGITAL UNITS BY TELEPHONE

The paper or digital units and “Silver Cards” and “Gold Cards» can be ordered:

ORDERING PAPER OR DIGITAL UNITS OVER THE INTERNET AND CONCLUDING THE SALE ONLINE

The “double click” of the Client under the purchase order constitutes an electronic signature that, between the parties, has the same value as a handwritten signature; it being understood that with the first click, the Client confirms his Order and with the second click he definitively accepts it after having reviewed it. The Order will be registered after the second click. Any Order signed by the Client is a binding commitment.

Records stored on the Seller’s computer systems under reasonable security conditions, will be considered as proof of communications, Orders and payments between the Parties. The archiving of purchase orders and invoices is made on reliable and durable media that can be produced as evidence.

To finalise the Order the Client must necessarily take the following steps:

  1. Go to the Website;
  2. Follow the Website’s instructions and in particular the instructions for opening an account;
  3. Fill in the Order form. In case of prolonged inactivity during the connection, it is possible that the Items and services selected by the Client before this inactivity are no longer available. The Client is then prompted to resume his selection of Items and services from the beginning;
  4. Check the ordered items and if necessary, identify and correct errors;
  5. Confirm the Order, the Total Price and the All-inclusive Price, the “Validating the Order”.
  6. Read and accept the General Sales Conditions
  7. Follow the online payment instructions of the server to pay the All-inclusive Price.
  8. The Client then electronically receives without delay a confirmation of the Order payment.
  9. The Client also receives electronically without delay an Order Confirmation (the «Order Confirmation»).
  10. Delivery will be made at the delivery address indicated by the Client in the Order.

When carrying out the various steps of the aforementioned Order, the Client undertakes to respect these contract terms pursuant to Article 1316-1 of the Civil Code.

The Seller agrees to fill the Order only within the limits of availability. In the absence of availability, the Seller undertakes to inform the Client.

However, the Seller reserves the right to refuse the Order if it is abnormal, in bad faith or for any other legitimate reason, especially if there was a previous dispute with the Client regarding payment of an order.

PRICE OF PAPER AND DIGITAL UNITS

Prices are in euros and valid until 30 November 2016.

The Price refers to the Total Price. They do not include the Delivery Cost, charged as extras and shown on the Order form before validation. Prices include all taxes, as well as the VAT applied on the French national territory on the date of the Order. Any change to the VAT rate will be reflected in the Price of the paper or digital units. Payment of the full Price must be made when ordering.

UNIT PAYMENT TERMS

Paying the All-inclusive Price by the Client is carried out via one of the following payment methods: Cash, check, credit card, e-banking card, or bank transfer.

If paying by credit card, the Client’s card is immediately debited after verification of the card and upon receipt of the debit authorisation from the card’s issuer.

The commitment to pay given by means of a payment card is irrevocable. By providing information related to the credit card, the Client authorises the Seller to debit their credit card for the amount corresponding to the All-inclusive Price.

To this end, the Client confirms that he is the owner of the credit card debited and that the name on the credit card is actually his own. The Client communicates the sixteen digits, the expiration date, and, where appropriate, the numbers of the security code.

In cases where debiting the All-inclusive Price is not possible, the Online Order will be immediately cancelled.

DELIVERY OF PAPER VOUCHERS AND “SILVER CARDS” OR “GOLD CARDS»

The Client chooses one of the Delivery Methods offered on the Website when placing the Order.

The Client indicates his delivery address and is solely responsible for any delivery failure due to a wrong indication when ordering.

The Delivery Cost depends on the amount of the Order and the Delivery Method chosen. In any event, the Delivery Cost is given to the Client before validating the Order.

The Delivery Deadlines are available on the Website and may vary according to the availability of the Ordered Items.

The Delivery Deadlines are quoted in working days and correspond to average preparation and delivery of the Order within the Territory.

The Delivery Deadlines run from the date of the Order Confirmed by the Seller.

In case of a delivery delay, the Order is not cancelled.

If the Order has not yet been shipped upon the Seller’s receipt of the Client’s cancellation notice, the Delivery is blocked and the Client is refunded any amounts debited within fifteen days of receipt of the cancellation notice. In case the order has already been shipped upon the Seller’s receipt of the Client’s cancellation notice, the Client can still cancel the Order by refusing it. Then the Seller will refund the amounts debited and the return costs paid by the Client within fifteen days of receipt of the complete return in its original state.

The Client can track the Order’s progress in the space provided for that purpose on the Website.

The Client must check the condition of the packaging and the Items upon delivery.

The Client must ensure that the Items delivered correspond to the Order. RIGHT OF WITHDRAWAL

Pursuant to the provisions of Article L. 121-21-8 12° of the Consumer Code, the Items on the Website proposed by the Seller are not subject to the right of withdrawal provided in Articles L 121-21 et seq. of the Consumer Code for remote sales.

Consequently, the Items ordered on the Website are exclusively subject to the cancellation and modification terms provided in these General Sales Conditions and the user may not invoke a right of withdrawal.

INTELLLECTUAL PROPERTY RIGHTS

Brands of the Seller: “Camping Travel Club”, “Camping Cheque” and “Holiday Cheque” and all brands, figurative or not, and generally all other trademarks, illustrations, images and logos appearing on the Items, their accessories and their packaging, whether registered or not, are and remain the exclusive property of the Seller. Any total or partial reproduction, modification or use of the brands, illustrations, images, logos and elements for any reason and on any medium whatsoever, without the Seller’s express prior consent is strictly prohibited. The same goes for any combination or conjunction with any other mark, symbol, logo and more generally any distinctive sign intended to form a composite logo. The same goes for any copyright, drawing, model and patent owned by Seller.

DATA CONFIDENTIALITY

The information requested from the Client is required to process the Order.

In the event the Client agrees to disclose his personal data, he has an individual right of access, withdrawal and rectification of this data in accordance with Law no. 78-17 of 6 January 1978 relating to computers, files and liberties. The Client is informed that the Website uses Cookies designed to be only used by the Seller. At each connection to the Website, Cookies allow recording the following information: the type and version of the Client’s browser, the date and time of visit, the history and content of Orders, including those not finalised.

Thus, upon future connections, the Client does not need to enter certain information again.

FORCE MAJEURE

The Seller’s obligations under this Contract shall be suspended upon the occurrence of a fortuitous event or force majeure that would impede or delay their execution.

The Seller will notify the Client of the occurrence of such a fortuitous event or force majeure within 15 days from the occurrence date.

If the Seller’s obligations continue to be suspended for a period exceeding 30 days, the Client may terminate the current Order and the Seller then will refund the Order under the conditions specified above.

REVOCATION OF A CLAUSE OF THE GENERAL SALES CONDITIONS

If any provision of these terms of sale is revoked, this shall not result in the revocation of the other provisions of the General Sales Conditions, which shall remain in force between the Parties.

GOVERNING LAW

These General Sales Conditions are governed by French law.

JURISDICTION

Any dispute arising from the formation, interpretation or execution of these general sales conditions will fall under the exclusive jurisdiction of the courts of the Client’s place of domicile for those living in France and the courts of Montpellier, France for Clients abroad, notwithstanding plurality of defendants or guaranteed appeal.
